Social Security Fairness Act

Receiving a public pension from MERS should not impact a Social Security benefit that was also earned by the member or their spouse. Previous reductions to Social Security benefits known as the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO) were repealed by Congress in 2025, through the Social Security Fairness Act. The repeal of the WEP and GPO was effective for all monthly insurance payments made after December 2023.
