If you are married during your membership with MERS, but later divorced, your ex-spouse may be eligible to receive a portion of your retirement benefit, DROP funds, or employee contributions.

Louisiana is a community property state, so benefits accrued under MERS are subject to Louisiana community-property laws. A member in the process of divorce should have an attorney address division of retirement benefits in a court-issued property settlement.
